On December 8, 2022, the Lea County Commission voted to adopt an ordinance requiring abortion providers to comply with federal law in the unincorporated parts of Lea County, New Mexico. Through the passage of this ordinance, abortion was outlawed de facto.
The passage of this measure made the unincorporated community of Monument (pop. 217) the first unincorporated community in the nation, and the first unincorporated community in New Mexico, to find themselves under an enforceable ordinance which result in the cessation of abortion within their unincorporated community.
The vote also made Monument the first census designated place in the nation, and the first census designated place in New Mexico, to find themselves under an enforceable ordinance which result in the cessation of abortion within their CDP.
The vote of the Lea County Commission, which covered the unincorporated community and CDP of Monument, was unanimous, 5-0.
