DownloadOn June 11th, 2019 the City of Waskom became the first city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The ordinance passed 5-0.

In February of 2020 the ACLU of Texas and ACLU National filed a lawsuit on behalf of two abortion assistance groups against seven of the twelve cities which had outlawed abortion at that time. Waskom was the first city named in the lawsuit. The two abortion assistance groups represented by the ACLU were the Lilith Fund for Reproductive Equity and the Texans for Equal Access Fund. While the cities were encouraged by the ACLU to retract the ordinances which they had enacted, all seven cities chose to amend and strengthen their ordinances outlawing abortion. The City of Waskom amended their ordinance on March 11th, 2020 and by the end of May the ACLU withdrew their lawsuit.
The lawsuit did not cost the City of Waskom or their taxpayers one cent and abortion remains banned in Waskom, Texas.
On September 9th, 2019 the City of Omaha became the first city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The ordinance passed 5-0.

Unfortunately, on October 14th, 2019, Omaha’s City Attorney attempted to “walk back” the city council from the ordinance and convinced them to adopt a non-binding resolution instead. Technically the ordinance was never voted down, but it was clear that was the desired intention of the majority of the council. The vote, which was to adopt a resolution in place of the ordinance, was 3-2. This made the City of Omaha the first in the nation to reject an ordinance outlawing abortion which they had previously passed.
While we no longer recognize Omaha as a ‘Sanctuary City for the Unborn’ and have placed them in the ‘Denying Sanctuary’ category, the City of Omaha will always be the second city to pass an ordinance outlawing abortion. Hopefully the City of Omaha will readopt an ordinance outlawing abortion in the near future.
On September 9th, 2019 the City of Naples became the third city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The ordinance passed 5-1.

The City of Joaquin amended their ordinance on March 17th, 2020 and by the end of May the ACLU withdrew their lawsuit.
The lawsuit did not cost the City of Joaquin or their taxpayers one cent and abortion remains banned in Joaquin, Texas.
On September 23rd, 2019 the City of Tenaha became the fifth city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The vote was unanimous.

On September 24th, 2019 the City of Gilmer became the sixth city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The vote was 4-1 with two council members not present for the vote.

On November 18th, 2019 the City of Westbrook became the seventh city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The vote was 3-0.

On November 21st, 2019 the Rusk City Council voted 3-0 to table the Sanctuary City for the Unborn ordinance in order that they might vote on the ordinance with a full council at a future date.
On January 9th, 2020 the Rusk City Council untabled the ordinance and passed the ordinance in a 3-2, vote making the City of Rusk the eighth city in the nation to pass an enforceable ordinance outlawing abortion within their city limits.

On December 10th, 2019 Colorado City’s City Council heard a first pitch encouraging an ordinance outlawing abortion to be passed within their city limits.
On January 14th, 2020 the City of Colorado City became the ninth city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The vote was 5-1.

On October 17th, 2019 the City of Gary voted to table the Sanctuary City for the Unborn Ordinance.
On January 16th, 2020 the Gary City Council voted to untable the ordinance and voted to become the tenth city in the nation to pass an enforceable ordinance outlawing abortion within their city limits. The vote was unanimous.

On November 12th, 2019 the City Council of Big Spring heard a first pitch encouraging an ordinance outlawing abortion to be passed within their city limits.
On December 10th, 2019 the Big Spring City Council voted to table the ordinance outlawing abortion. The vote was 5-2.
On January 14th, 2020 the Big Spring City Council voted to untable the ordinance and vote in the first of two readings to pass the Sanctuary City for the Unborn Ordinance. The ordinance passed the first reading in a 3-2 vote with 1 council member choosing to abstain from voting. On January 28th, 2020 the ordinance passed a second and final reading with a 4-2 vote making the City of Big Spring the eleventh city in the nation to pass an ordinance outlawing abortion within their city limits.

On Thursday, April 15th, 2021 Planned Parenthood started murdering innocent unborn children in Lubbock, Texas.
Early voting for the passage of Lubbock’s Sanctuary City for the Unborn Ordinance began on April 19th, 2021.
On Saturday, May 1st, 2021, the citizens of Lubbock, Texas (pop. 264,000) outlawed abortion by citywide vote. The adoption of the measure made the City of Lubbock the twenty-sixth city in the nation, and the twenty-fourth in Texas, to pass an enforceable ordinance outlawing abortion within their city limits.
The results of the citywide vote were 62% FOR the passage of the ordinance and 38% AGAINST the passage of the ordinance - a difference of 24 points.

Lubbock was met with a lawsuit from the ACLU of Texas representing Planned Parenthood of Greater Texas and their employees on Monday, May 17th, 2021.
A hearing was held on Friday, May 28th, in the courtroom of the Honorable Judge James Wesley Hendrix of the United States District Court for the Northern District of Texas. Prior to the hearing Judge Hendrix asked the Office of the Attorney General to respond to the views on the questions of Texas laws which were presented by Planned Parenthood in this particular case. In response to the request, Judd E. Stone, the Solicitor General of Texas, released a seven page letter on May 31st, to Judge Hendrix’s court. The letter stated that in their view “Lubbock’s ordinance is entirely consistent with state law.”
On the morning of June 1st, 2021 the ordinance went into effect and Planned Parenthood in Lubbock, Texas ceased performing abortions.
Late on June 1st, 2021 Judge Hendrix ruled in Planned Parenthood of Greater Texas Surgical Health Services, et al. v. City of Lubbock, Texas with a 50 page ruling dismissing Planned Parenthood’s case for a lack of jurisdiction.
Since the ordinance went into effect on June 1st, 2021, Planned Parenthood has complied with the ordinance and abortions have not been performed in Lubbock, Texas.
On May 10th, 2021 the City of Abernathy, Texas became the twenty-seventh city in the nation, and the twenty-fifth city in Texas, to pass an enforceable ordinance outlawing abortion within their city limits.

On June 21st, 2021 the City Commission of Eastland, Texas discussed an ordinance which would outlaw abortion within their city limits. The City Commission voted 5-0 in a procedural vote which directed the City Attorney to work with Mark Lee Dickson on an ordinance outlawing abortion which would be voted on at their next city council meeting.
On July 9th, 2021 the Eastland City Commission voted 4-0 in a first reading vote to outlaw abortion within their city limits.
On August 4th, 2021 the Eastland City Commission voted 5-0 in their second and final reading vote to outlaw abortion within their city limits. On November 8th, 2021 the Anson City Council had their second reading vote to outlaw abortion within their city limits. The vote was 5-0. In doing so the City of Anson became the forty-second city in the nation, and the thirty-eighth city in Texas, to pass an enforceable ordinance outlawing abortion within their city limits.

While the Slaton Ordinance was first introduced and discussed before the Slaton City Commission on Monday, July 12, 2021 the ordinance did not have its first reading until Monday, November 15, 2021. The first reading vote of the Slaton City Commission was 4-1.
At the next meeting, on December 13th, the Slaton City Commission passed the ordinance in a second and final reading with a 5-0 vote. In doing so the City of Slaton became the forty-third city in the nation, and the thirty-ninth city in Texas, to pass an enforceable ordinance outlawing abortion within their city limits.

In doing so the City of Shallowater became the forty-fifth city in the nation, and the forty-first city in Texas, to pass an enforceable ordinance outlawing abortion within their city limits. The vote was 5-0.

On January 7th, 2020 the Lindale City Council heard a first pitch from Lindale residents who wished to see their city council pass an ordinance outlawing abortion within their city limits.
This was followed by a second pitch (January 21st, 2020), a third pitch (February 4th, 2020), and a fourth pitch (February 18th, 2020).
After the fourth pitch by residents in favor of the ordinance the Lindale City Council, at the advice of their City Attorney, rejected the request of their citizens to pass an enforceable ordinance outlawing abortion within their city limits. Instead, the City Council of Lindale passed a non-binding resolution that the citizens of Lindale never asked for.
A citizen initiative petition was filed by residents of the city of Lindale in January 2022 and, as a result, a public hearing was held. The City Council of Lindale voted unanimously to pass the ordinance to outlaw abortion within their city limits, becoming the first city council to vote on an ordinance as a result of a citizen initiative petition. In doing so the city also became the forty-seventh city in the nation, and the forty-second city in the state of Texas, to pass an enforceable ordinance outlawing abortion. The vote was 4-0.

The results of the citywide vote were 58% FOR the passage of the ordinance and 42% AGAINST the passage of the ordinance - a difference of 16 points.

The results of the citywide vote were 53% FOR the passage of the ordinance and 47% AGAINST the passage of the ordinance - a difference of 6 points.

The adoption of the measure made the City of San Angelo the sixtieth city in the nation, and the forty-seventh in Texas, to pass an enforceable ordinance outlawing abortion within their city limits.
The results of the citywide vote were 56% FOR the passage of the ordinance and 43% AGAINST the passage of the ordinance - a difference of 12 points.

The adoption of the measure made the City of Plainview the sixty-first city in the nation, and the forty-eighth in Texas, to pass an enforceable ordinance outlawing abortion within their city limits.
The results of the citywide vote were 69% FOR the passage of the ordinance and 31% AGAINST the passage of the ordinance - a difference of 38 points.
